AirAsia in hot water with ACCC over Bali route

CHOICE calls on the ACCC to investigate AirAsia over dodgy ticket sales

CHOICE has written to the ACCC and urged it to investigate AirAsia* after the airline cancelled direct flights from Melbourne to Bali with as little as 24 hours' notice, having sold tickets on a route it did not have permission to fly.

“On Christmas Day the airline notified travellers that direct flights from Melbourne to Bali would be cancelled and offered them a 13-hour journey flying via Malaysia instead of the six-hour direct flight advertised by the airline,” says CHOICE head of media Tom Godfrey.

“Most consumers understand that flights can be cancelled and delayed, and are willing to share that risk with airlines. But asking consumers to accept a risk that an airline is not accredited to fly is a step too far.”

“The fact is consumers purchased direct flights to Bali but they ended up being flown around the houses coming in via Malaysia. AirAsia sold one thing and delivered something different – and in the process it misled consumers.”

“It is also highly likely that AirAsia’s decision to cancel the direct flight resulted in consumers’ holiday plans being thrown into disarray with many incurring cancellation costs.”

“If the route alteration had a major impact on holiday plans, where a holiday was the reason the flights were purchased, it constitutes a major failure under Australian Consumer Law (ACL).

“Our consumer protections apply to airlines the same way they apply to other goods and services. While some delays and cancellations are genuinely beyond the control of airlines, they still need to comply with consumer guarantees,” says Mr Godfrey.

“If the airline misled consumers or acted in a way that constitutes a ‘major failure’ under consumer law, consumers should be able to seek compensation from the airline for any unexpected expenses they have had as a result of the cancellation.”

CHOICE has asked the ACCC to:
  • Seek pecuniary penalty against AirAsia for violating s34 of the ACL;
  • Declare that the cancellation of the direct route constitutes a major failure
  • Direct AirAsia to pay affected customers eligible compensation for out-of-pocket expenses, including writing notifications to all affected customers about their rights to claim;
  • Seek fixed sum compensation payment for the failure to provide customer service of an acceptable quality to the affected consumers. This compensation should be in addition to any consequential loss.

CHOICE is unaware of the exact number of consumers who have been affected. However the attractively low price of direct flights to a premiere holiday destination offered for use during the summer holiday season was likely to have caught out a large number.

AirAsia is a group of several airlines which operate under the ‘AirAsia’ brand. This complaint relates to Indonesia AirAsia Extra (or ‘Indonesia AirAsia X’). Indonesia AirAsia X is a new airline and the route between Bali and Melbourne was to be the airline’s first and only planned flight. Consumers who flew the diverted route via Malaysia would have flown on another AirAsia affiliate and not Indonesia AirAsia X.

The design team led by design visionaries from Uniworld’s award-winning sister company The Red Carnation Hotel Collection, President and Founder, Beatrice Tollman, her daughter, Toni Tollman, and Projects Director Brian Brennan took inspiration from the Baroque period over which Maria Theresa presided. “Our aim is to transport each guest into experiencing the fantasy of living in an 18th-century Baroque castle. Certainly this is evident when guests step onboard the S.S. Maria Theresa. Shimmering walls are paneled top to bottom with stunning antique mirrors. And perhaps the ultimate focal point of this grand entranceway and the centerpiece of Uniworld’s majestic ship is a regal ten-foot high original oil on canvas painting of the beloved ruler of the Habsburg Empire, Maria Theresa.

Throughout the S.S. Maria Theresa, royal blue, antique golds, shades of white, and soft gray colors that were popular during the 18th century abound. Design features include mirrored or silk-clad walls, antique white wood paneling, carved twisted columns, Habsburg coronets hand-painted with 22-carat gold leaf, and custom furniture pieces, made by master craftsmen. This intricate handiwork has been painstakingly accomplished by a team of skilled artisans from around the world, including ceramicists and specialist painters who were commissioned to ensure the period was recreated with authenticity, luxury, passion, and detail.

In the Habsburg Salon, where guests can relax with a book or enjoy afternoon tea, are five murals depicting the 18th-century Austrian countryside hand-painted by specialist painter Croxford and Saunders. The Accor network has added to its upscale MGallery Collection of hotels with the addition of The New Inchcolm Hotel & Suites, the brand's first MGallery for Brisbane, and its tenth address across Australia and New Zealand.

Indeed, this heritage-listed hotel has been influenced in every way by its incredibly rich history, which dates back to the 1880s when immigrant Dr John Thomson chose the site to build his personal residence. The accomplished doctor, scientist, astronomer, psychologist and pioneering photographer (who in addition was also a founder of St. John's Ambulance and QLD University), named his home Inchcolm after Scotland's Inchcolm Island.

The building that is The New Inchcolm Hotel and Suites today was built during the 1920s, replacing Dr Thomson's home and private medical practice which was originally built to house the rooms of a number of medical specialists. In 1997, the building was purchased by its current owner, iconic Brisbane developer Peter Flynn, who has a special connection to property having been born in the building during its medical practice days.

Flynn's vision to create a New York style boutique hotel saw The Inchcolm Hotel open its doors in 1998. Rekindling this vision in 2014, The New Inchcolm Hotel and Suites underwent a major refurbishment and expansion and has relaunched in 2015 as a premier accommodation option in the reinvigorated Spring Hill precinct.

Solomon Airlines to fly Sydney-Honiara service from June






SOLOMON AIRLINES TO COMMENCE NEW SYDNEY- HONIARA SERVICE FROM JUNE

Airline to launch new service with AUD599* introductory airfare inclusive of taxes

Offering major potential for the Solomon Islands business, leisure and VFR markets, Solomon Airlines announced today that it will commence operation of a direct Sydney-Honiara service from 02 June, 2015, subject to government approval.

Scheduled to operate ex-Honiara on Mondays and ex-Sydney on Tuesdays, the airline will herald the new service with a special AUD599* return fare inclusive of all taxes, in-flight meals and entertainment plus a generous 30 kilo baggage allowance.

Solomon Airlines will utilise its Airbus A320 on the new route which has been specifically timed to offer seamless flight linkage between several Australian cities and also international connections.

These include Canberra, Melbourne and Perth and internationally, for passengers connecting to and from New Zealand, the US, Asia, the Middle East, the UK and Europe.

The new flight schedule will operate as follows:

Rebranding to reflect expertise of ‘insider experiences’ within Small Group Journeys

After 21 years Asia travel specialist Travel Indochina is rebranding to Insider Journeys, effective from 2nd February 2015.

Managing Director and Co-Founder, Paul Hole says the change better reflects the philosophy and core focus of the company, and taps into the romance of travel.

“In recent years as we’ve expanded well beyond the Indochina region into much of Asia including Japan, China, India, Sri Lanka and Bhutan, we’ve been torn over changing our name, which reflects our heritage, to something that better articulates who we are,” explains Hole.

“We now feel that with 21 years’ history and experience, we’ve ‘come of age’ and the time is right to make this major change that captures the notion of richer, more intimate travel experiences in the style of travel we offer.
